Mass tort cost per signed retainer benchmarks

These are the current cost-per-signed-retainer (CPR) and signed-rate benchmarks for 14 active mass torts, covering Q1 2026 and current as of March 31, 2026. The national median CPR is $3,850. Figures draw on a panel of 140 plaintiff-side firms representing roughly $180M of annual mass tort lead spend, cross-referenced against published industry surveys. Every value below is either taken from that dataset or marked n/a with a reason — nothing is estimated, smoothed, or filled in.

Data as of Updated Q1 2026 release

National median cost per signed retainer · Q1 2026

$3,850

+24% versus $3,100 in Q4 2024, the prior published national median.

Change is measured against the Q4 2024 benchmark, the prior published national median. The intervening quarters are not held in the dataset, so a true quarter-over-quarter change is not computable.

  • TCPA compliance premiums on consent-verified lead flow
  • Rising digital ad CPMs
  • Tighter MDL-level case qualification criteria
Sample size
n/a — Panel totals (140 firms, $180M annual spend) are published, but the count of firms contributing to the national median specifically is not tracked in the published dataset.
Confidence interval
n/a — Not computable. The published dataset carries interquartile ranges, not the per-observation values a confidence interval requires.

CPR is the interquartile low and high bound. Per-tort medians, sample sizes, and confidence intervals are marked n/a where the dataset does not carry them — hover any n/a, or open “Why some cells read n/a” below, for the reason.

CPR median
Per-tort medians are not published. The dataset carries the interquartile low and high bounds for each tort; only the national median is published as a point value.
Sample size
Per-tort sample sizes are not broken out in the published dataset. The panel total (140 firms, $180M of annual mass tort lead spend across 16 active tort categories) is published at the panel level only, so the number of firms and the spend basis behind any single row cannot be stated.
Confidence interval
Not computable from the published dataset. Benchmarks are published as trimmed interquartile ranges, and the per-observation values a confidence interval requires are not retained in the published figures.
Row updated
Rows are refreshed as a complete set each release, so every row carries the release publication date rather than an independent per-row date.

How these numbers are calculated

The short version. The methodology page carries the full definitions, the panel description, the known limitations, and a dated changelog.

What counts as a signed retainer

A signed retainer that survives the 30-day falloff window: the claimant has signed, cleared medical-record verification, and remains engaged with the firm after 30 days. A raw signed count taken before falloff overstates real performance by 15–28% on average, so it is not what these figures measure.

What counts as qualifying spend

Media and lead-acquisition spend reported by panel firms against the tort in question, for the quarter in question. Spend is attributed to the quarter it was incurred, not the quarter a resulting retainer was signed.

How falloff is treated

Falloff is netted out of the denominator before CPR is computed, not reported alongside it. A retainer that falls off inside 30 days is not counted as signed, so the CPR shown already carries the cost of the leads that produced it.

What is excluded

Observations above the 95th percentile and below the 5th percentile are trimmed before the interquartile range is taken, so a single catastrophically underperforming or anomalously cheap campaign cannot move a published band.

Formula. CPR = qualifying spend ÷ signed retainers surviving the 30-day falloff window. Bands are trimmed interquartile ranges across panel firms, not averages. Per-tort medians, per-row sample sizes, and confidence intervals are not currently derivable from the published dataset and are shown as n/a rather than approximated.
